Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and SimBusiness ("SimBusiness," "we," "us," or "our") governing your use of the SimBusiness game application (the "Game") and this website at sim-business.net (together, the "Services"). Please also read our Privacy Policy, which is part of these Terms.

1. Acceptance of these Terms

By creating an account or using the Services, you agree to these Terms. When you sign up for the Game, you are asked to accept these Terms and the Privacy Policy, and we may record your acceptance, the version accepted, and the date and time. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 13 years old to use the Services. If you are between 13 and 17, or under the age of majority where you live, you may use the Services only with the involvement of a parent or guardian who agrees to these Terms on your behalf. By using the Services you represent that you meet these requirements.

3. The Game is for entertainment, not advice

SimBusiness is a simulation game offered for entertainment. Outcomes, numbers, narratives, and other content are generated by software and artificial intelligence for the purpose of play and may be inaccurate, incomplete, or unrealistic. The Services do not provide professional business, legal, financial, accounting, tax, or investment advice, and nothing in the Game should be relied upon as such. Always consult a qualified professional before making real-world decisions.

4. Your account

You are responsible for the activity on your account and for keeping your login credentials secure. Provide accurate information and notify us of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

5. Tokens, purchases, and pricing

The Game uses tokens. You may receive free tokens and may purchase additional tokens. Pricing is intended to cover hosting and development costs and to keep the Game low-cost. Token purchases are final: all sales are non-refundable except where a refund is required by applicable law. Tokens have no cash value, are not transferable, and we may change pricing or token mechanics prospectively.

6. Your content and the license you grant us

"Player Content" means the content you enter or generate while using the Game, including business designs, prompts, free-text inputs, decisions, and resulting turn data and narratives. As between you and us, you keep whatever rights you have in Player Content you contribute.

You grant SimBusiness a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, adapt, create derivative works from, publish, and otherwise use your Player Content for any purpose, including to operate, analyze, and improve the Services and to train, fine-tune, and develop machine-learning models (our own and/or those of others). This license excludes your username and your profile description information. Much of the content produced during play is generated by artificial intelligence; you acknowledge that such AI-generated content may not be subject to copyright, and this Section is a contractual license over your account content rather than a claim of exclusive ownership of AI output.

You represent that you have the rights necessary to grant this license and that your Player Content does not violate the law or the rights of others.

7. Acceptable use and content standards

SimBusiness is intended to be family-friendly. You agree not to submit content that is unlawful, infringing, hateful, harassing, sexually explicit, or otherwise objectionable, and not to misuse the Services, attempt to disrupt them, reverse engineer them, or use them to violate any law. We may remove content and suspend access for violations.

8. Intellectual property

The Services, including their software, design, text, graphics, and branding (other than Player Content), are owned by SimBusiness or its licensors and are protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose, subject to these Terms.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any content is accurate.

10. Limitation of liability

To the extent permitted by law, SimBusiness will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us for tokens in the three months before the claim or US$50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

11. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. Sections that by their nature should survive termination — including the content license, disclaimers, limitation of liability, and governing law — will survive.

12. Governing law and venue

These Terms are governed by the laws of the State of Missouri, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Missouri have exclusive jurisdiction and venue over any dispute that is not otherwise resolved, subject to any mandatory rights under your local law.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect means you accept the updated Terms.
